2003-07-18 Decision on the motion for leave to intervene, Bi, This is an application by the Attorney General of Alberta for an extension of time and for leave to intervene in this appeal. The application for an extension of time is granted. Insofar as the Attorney General of Alberta seeks to widen the issues beyond those framed by the parties, the application should be denied. Apart from anything else, point (iii) would require a substantial factual record with respect to specific treaties and their specific provisions, and such enlargement of the factual record is simply beyond the scope of this appeal.

Accordingly, the intervention of the Attorney General of Alberta, as with that of other interveners, must be restricted to the issues framed by the parties and other matters incidental thereto that do not require further evidence or other supplement to the record filed by the parties.

On that more restricted basis, the motion for leave to intervene of the applicant, the Attorney General of Alberta, is granted and the applicant shall be entitled to serve and file a factum not to exceed 20 pages in length.

The request to present oral argument is deferred to a date following receipt and consideration of the written arguments of the parties and the interveners.

As stated, the applicant, the Attorney General of Alberta, shall not be entitled to adduce further evidence or otherwise supplement the record of the parties.
