The profits from the Sucroë soundtrack and the Jaffa Road amount are reinstated in the trial judge’s calculation of profits. The trial judge’s order of non-pecuniary damages is reinstated. Punitive damages of $500,000 are awarded, subject to apportionment on a joint basis as specified in the reasons.
Mr. Robinson and Nilem are awarded costs throughout. The trial judge’s award of $1,500,000 in solicitor-client costs for the proceedings at the trial level is confirmed.
