2015-01-16 | Judgment on the appeal rendered, CJ LeB Abe Ro Cro Ka Wa, The appeal from the judgment of the Court of Appeal for Ontario, Number C-50475, 2012 ONCA 363, dated June 1, 2012, heard on February 18, 2014, is allowed with costs to the appellants throughout. Rothstein J. is dissenting. Section 96 of the Royal Canadian Mounted Police Regulations, 1988, was unconstitutional and would have been declared to be of no force or effect had it not been repealed. Paragraph (d) of the definition of “employee” at s. 2(1) of the Public Service Labour Relations Act is unconstitutional and is of no force or effect. This declaration of invalidity is suspended for a period of 12 months. The constitutional questions are answered as follows: 1) Does s. 96 of the Royal Canadian Mounted Police Regulations, 1988, SOR/88-361, infringe s. 2(d) of the Canadian Charter of Rights and Freedoms? Yes. Rothstein J. would answer no. 2) If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms? No. Rothstein J. finds it unnecessary to answer this question. 3) Does paragraph (d) of the definition of “employee” at s. 2(1) of the Public Service Labour Relations Act, S.C. 2003, c. 22, infringe s. 2(d) of the Canadian Charter of Rights and Freedoms? Yes.
