Rothstein, Moldaver and Wagner JJ. are dissenting. The mandatory minimum sentences imposed by s. 95(2)(a)(i) and (ii) of the Criminal Code, R.S.C. 1985, c. C-46, are inconsistent with s. 12 of the Canadian Charter of Rights and Freedoms and are therefore declared of no force or effect under s. 52 of the Constitution Act, 1982. However, Mr. Charles’ sentence was appropriate and is upheld. Dismissed |
