2016-04-15 Judgment on the appeal rendered, CJ Abe Cro Mo Ka Wa Ga Côt Br, The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA041594, 2014 BCCA 224, dated June 6, 2014, heard on January 13, 2016, is allowed. Section 5(3)(a)(i)(D) of the Controlled Drugs and Substances Act, S.C. 1996, c. 19, is unconstitutional and is therefore of no force or effect under s. 52(1) of the Constitution Act, 1982. The sentence of the Court of Appeal is set aside and the sentence of one year of imprisonment imposed by the provincial court judge is restored. Wagner, Gascon and Brown JJ. are dissenting in part.

The motions for leave to intervene of the Pivot Legal Society and the Union of British Columbia Indian Chiefs (joint), the African Canadian Legal Clinic, the British Columbia Civil Liberties Association, the Canadian Bar Association, the HIV & AIDS Legal Clinic Ontario, the Canadian HIV/AIDS Legal Network, the British Columbia Centre for Excellence in HIV/AIDS, the Prisoners with HIV/AIDS Support Action Network, and the Canadian Association of People Who Use Drugs (joint), the Criminal Lawyers’ Association (Ontario) and the West Coast Women’s Legal Education and Action Fund are granted and the said seven (7) interveners or groups of interveners shall be entitled to each serve and file a factum not exceeding ten (10) pages in length on or before December 23, 2015.
The requests to present oral argument are deferred to a date following receipt and consideration of the written arguments of the parties and the interveners.
The interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.
Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners shall pay to the appellant and respondent any additional disbursements occasioned to the appellant and respondent by their intervention.

Any attorney general who intervenes pursuant to para. 61(4) of the Rules of the Supreme Court of Canada shall pay the appellant and respondent the costs of any additional disbursements they incur as a result of the intervention.
IT IS HEREBY FURTHER ORDERED THAT:
1. Any attorney general wishing to intervene pursuant to para. 61(4) of the Rules of the Supreme Court of Canada shall serve and file their factum and book of authorities on or before December 23, 2015.
