Decision on motion to extend time to file and /or serve the leave application, Co, There is no question that the Crown intended to seek leave to appeal very shortly after receiving the reasons of the Court of appeal. Unfortunately an error was made. The Crown law officer believed that the Criminal Code time limits applied whereas the Young Offenders Act governed. The unfortunate young person is in custody awaiting trial on several break and enter charges. This is a serious case. Two women were murdered. The young person was found guilty at trial. The Court of Appeal found that verdict unsafe and entered an acquittal. The issues which arise from the decision are significant and should be considered on a leave to appeal application. An order will go extending the time for filing the application to the 16th July\90. The Crown must ensure that all the necessary material and factum are filed by that date to ensure that there is no prejudice or at least minimal prejudice to the unfortunate respondent. As soon as the respondent's factum is filed this application will be immediately placed on the list for hearing. Granted, no order as to costs |
