At that time the papers will be delivered to the leave panel. The issues raised may be significant. At this stage it cannot be said that they are frivolous or devoid of merit. It would seem to be sensible to stay the proceedings for the relatively short time that would elapse prior to the determination of the application for leave to appeal. If leave to appeal is refused the stay will automatically terminate. If leave is granted the applicant will have to again apply for a stay and the question will have to be reconsidered in light of the circumstances prevailing at that time.
