Decision on motion to extend time to file and /or serve the leave application, Co, The application to extend time for leave to appeal the Order of the Nova Scotia Court of Appeal dated the 24th of July 1998 is granted subject to the following conditions: 1) The applicant will complete, serve & file the application for leave to appeal on or before the 1st of June 1999. 2) The perfection of the application for leave to appeal is to be completed without regard to any proceedings for breach of trust that the applicant may see fit to intitute. 3) The various costs awards made against Frederick Black and referred to in the reasons of both Justice Hallett writing for the majority and Justice Cromwell for the minority are to be paid in full by bank draft, certified cheque or cash on or before the 31st day of May 1999. 4) If these conditions are not fulfilled, this application is to be dismissed with costs.
