2001-01-17 Decision on the motion for a stay of execution, (revised January 23, 2001), G, By her motion, applicant applies for a stay of proceedings before the Ontario Board of Inquiry on her complaint of discrimination in employment pending disposition of her application for leave to appeal from a judgment of the Ontario Court of Appeal denying leave to appeal to that court, a pre-hearing conference call having been scheduled by the Board for January 18, 2001 at 5:00 p.m. The applicant had sought leave to appeal to the Court of Appeal from a judgment of the Divisional Court allowing in part the applicant's application for review of and reversing an interim decision of the Board of Inquiry finding it lacked jurisdiction to add parties. The Board is master of its own process and empowered to grant adjournments as are appropriate to the circumstances. I am not satisfied that the applicant is reasonably at risk of suffering irreparable injury by reason of inappropriate action of the Board pending determination by this Court of the application for leave to appeal. The motion for a stay is dismissed.
