Decision on the bill of costs, taxed at the amount of $1,985.87 , Reg, The Supreme Court dismissed the application for leave to appeal with costs on March 27, 2003. The respondent filed his bill of costs on April 25, 2003. I have examined the respondent's response on the application for leave and the respondent's bill of costs, and note that the response consists of eight books and totals 1,562 pages in length. As I stated in 1560036 Canada Inc. v. Les Pétroles Therrien Inc. (Que.) 27158, Bulletin of Proceedings of the Supreme Court of Canada, April 7, 2000, at p. 620: " It is well established that the parties must do their utmost to minimize costs, in particular with regard to the extensive reproduction of testimony, case law and other authorities". Consequently, the number of pages will be reduced to 400, which is equivalent to two books. Under section 1 (e) of Part I of the Tariff of Fees and Disbursements, the respondent is entitled to a fee based on the number of pages in the response as reduced above. As far as disbursements are concerned, the respondent is entitled to an amount based on the number of pages of the response as reduced above, and is not entitled to the amount claimed for the application for leave. I affirm the other elements of the bill of costs. The costs are taxed accordingly. Allowed in part |
