In 2003, the dieticians and nutritionists employed by a health-care facility filed a grievance under their collective agreement. The grievance arbitrator allowed the complaint, finding that the employees were subject to an excessive workload. In response to the arbitrator’s decision, the directors of the health-care facility issued instructions to the dieticians’ and nutritionists’ union regarding the prioritization of services dispensed by the facility’s professionals.

Unhappy with the measures taken by the employer, the union filed another grievance under the collective agreement. This time, the arbitrator found that the measures that had been taken were insufficient to remedy the excessive workload and ordered the health-care facility to hire more staff to correct the situation. An application for judicial review of this decision was dismissed by the Superior Court. The Court of Appeal allowed the health-care facility’s appeal, allowed the application for judicial review and dismissed the collective grievance.
