The respondent filed an action against the applicant, alleging breach of contract. In 2002, the Superior Court allowed the claim and ordered the applicant to pay for delivered goods and for transportation and storage costs. Before the hearing on the appeal, the applicant filed a motion to suspend the appeal and to stay the execution of part of the judgment on the ground that it wished to file a motion to revoke the judgment of the Superior Court in light of new evidence showing that the storage costs were not as high as alleged by the respondent. The Court of Appeal dismissed the motion on the ground that the alleged facts existed at trial, and subsequently dismissed the appeal. In 2004, the applicant filed a motion to revoke the order of the Superior Court, without success. The Court of Appeal dismissed the Applicant’s appeal on the ground that the allegations merely corroborated allegations made in the course of the initial proceeding and that the motion was tardy.
