Criminal law - Disclosure – Victim impact statement videotaped – Conditions of undertaking imposed by prosecution – Whether imposition of conditions for disclosure infringes right to make full answer and defence - Whether Superior Court erred in finding, pursuant to s. 24(1) of Canadian Charter of Rights and Freedoms, that Respondent’s right to silence and right to make full answer and defence violated when Respondent required to obtain leave of court to submit videotape to expert or any “competent person” - Whether Superior Court erred in broadening conditions of disclosure undertaking even though Respondent had not discharged burden of showing that this form of disclosure infringed his rights - Whether Superior Court erred in broadening proprio motu conditions of disclosure undertaking without considering interests of third parties.
Claude Ouellet was charged with three counts of committing sexual offences against a minor. During the police investigation, the victim made a statement that was videotaped. The prosecution required that Ouellet’s counsel sign an undertaking in order to receive a copy of the recording. The defence contests the reasonableness of the conditions imposed by the prosecution.
