Property law - Wills - Construction - Presumption against intestacy - Does the application of the presumption against intestacy act so as to negate findings of partial intestacy in the construction of wills? - When a testator does not expressly state that he or she wishes to not dispose of a portion of their estate but rather remains silent, does the silence create an ambiguity automatically triggering the application of the interpretive aid known as the presumption against intestacy? - Can a testator be found to be partially intestate absent a direct statement that he or she wished to be so? - Whether the Court of Appeal erred in affirming the trial decision.

Sundraj Naidu, the testator, died at St. John’s on November 18, 2003. He executed a holograph will on October 13, 2001. The Respondent, Gloria DeHart, is named a beneficiary in the will. Ms. DeHart met the testator in 1975. They had a very close relationship, which became romantic in 1998. The Applicant, Dr. Karutha Jayaraman, brother and next-of-kin of the testator, commenced an action seeking an interpretation of the clauses of the will of Sundraj Naidu and asking for direction on the distribution of the estate. At trial, it was held that the last will and testament of Sundraj Naidu was to be interpreted to mean that all of the assets of the testator, with the exception of lands in Malaysia, in which he held in joint interest with the Applicant, were bequeathed to the Respondent DeHart. The Applicant’s subsequent appeal was dismissed.
