Civil procedure - Pleadings - Motion to strike statement of claim pursuant to Rule 221 of the Federal Court Rules, 1998 granted by order of Prothonotary Milczynski on the basis that the substance of the cause of action in this proceeding is identical to that in an action already commenced by the plaintiff, and in which there has been a final disposition - Whether lower courts erred in dismissing the Applicant’s statement of claim - Whether the lower courts erred in failing to grant an extension of time - Whether lower courts erred in law - Whether there are issues of public importance raised.
The Applicant’s statement of claim was dismissed by order of Prothonotary Milczynski on the basis that it was “clear, based upon a review of the statement of claim, that the substance of the cause of action in this proceeding is identical to that in an action already commenced by the Plaintiff, and in which there has been a final disposition”. Barnes J. dismissed the motion to extend time and declared Mr. Wilson a vexatious litigant pursuant to s. 40 of the Federal Courts’ Act. On July 27, 2007, Sharlow J.A. dismissed the Applicant’s motion for an extension of time to appeal the decision of Barnes J. On November 20, 2007, Sharlow J.A. denied the motion for reconsideration.
