In an action by Parvez Ahmed against his former solicitor, security for costs were ordered. The statement of claim was later struck out for delay on the basis of Rule 56.06 of the Manitoba Court of Queen’s Bench Rules, the applicant having defaulted on filing the security for costs.
The Court of Queen’s Bench dismissed the applicant’s appeal from a Master’s order striking his statement of claim for failure to file security for costs. The Court of Appeal dismissed the applicant’s appeal.
