The applicant commenced an action against the respondent for what she claims is “dental malpractice” in Small Claims Court. Her action was dismissed. She wanted to appeal that decision and brought a motion to have the fee for obtaining the transcript waived. That motion was dismissed but the time to order the transcript was extended.

The applicant appealed to the Superior Court. The court dismissed the motion finding the decision was correct. The applicant’s alternate requests that she be allowed to proceed with the appeal without a transcript or that the respondent be ordered to pay for it were also dismissed. The Court of Appeal dismissed the motion for leave to appeal.
