Human rights — Failure to accommodate — Costs — Access to Justice - Should the Applicant be relieved of the obligation to pay costs or pay nominal costs?
The Applicant was a student at the Respondent’s law school. She failed to meet the requirements for first-year students. While the Respondent accommodated her disability, the adequacy of this accommodation is contested. The Applicant was subsequently readmitted as a first-year law student for medical reasons. The Respondent has refused to remove the unsuccessful academic year from the Applicant’s transcript.
