The Applicant, Mr. Singh is the registered owner of property subject to an eviction order. He was found in default of two mortgages on his house in Brampton and the Respondent mortgage lender`s action was allowed in Superior Court. Mr. Singh’s appeal to the Court of Appeal was dismissed as he had acknowledged the validity of the mortgages and payment default. His argument with respect to the sufficiency of the equity in the property was found to be irrelevant to the lender’s right for repayment and assertion of its security rights. Mr. Singh received the eviction order which was to take effect Tuesday, June 7th, 2016. His motion for a stay of execution was dismissed by Justice Côté on June 21, 2016.
