Four parallel class actions were filed, including the actions of both parties. On motion, the trial judge stayed three of them on the ground of lis pendens. The applicant was the first to file the class action. Therefore, she claimed she should be given priority to proceed first, in accordance with the Quebec “First to file” rule between competing motions to authorize the bringing of a class action. The respondent opposed this claim, stating that the applicant’s action is not in the putative class members’ best interests.
