The Applicant, Mr. Noddle was convicted of criminal harassment and breach of recognizance in October 2014 and was sentenced in December of that year. After being granted credit for time served in pre-sentence custody, Mr. Noddle was sentenced to one day in jail, followed by three years probation. In July 2015, Mr. Noddle filed a notice of appeal from his conviction and notice of application for leave to appeal the sentence and an application to extend the time to file the appeal. The Court of Appeal denied the extension of time.
