Summary

Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.

Mr. Euverman suffered from anxiety and depression after experiencing chronic homophobic harassment and discrimination in in the workplace. In 2013, he applied for a disability pension. Service Canada found that he was not eligible because he could not demonstrate that he was continuously disabled from December 2008. Service Canada came to the same conclusion after Mr. Euverman’s request for reconsideration. Mr. Euverman appealed that decision. The Social Security Tribunal of Canada (General Division) denied his appeal. The Social Security Tribunal of Canada (Appeal Division) denied his application for leave to appeal. Mr. Euverman’s application for judicial review of that decision was dismissed. The Federal Court of Appeal dismissed his appeal.
