2022-06-30 Correspondence received from, (Letter Form), The only issues to be determined by the Supreme Court in this case are these:
1. Do the respondents have the right to impute the views of lawyers and prosecute them for it in light of s. 23 of the United Nations Basic Principles on the Role of Lawyers? If not, they should summarily be found guilty for its violation.
2. If so, we should be cross-examined on the specific views they impute to us. If we affirm any of these views, and it is against the law to do so, then an appropriate remedy should be ordered. , (Printed version due on 2022-07-08)

Summary

Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.

The applicant, Mr. Hamza, is a lawyer in London, Ontario. He made comments on the LinkedIn platform which led the individual respondents, Mr. Aderonmu, Ms. Soubas, Ms. Huggins and Mr. Rocheleau to make complaints to the respondent Law Society of Ontario (LSO). They alleged that the applicant’s comments were made in violation of the Rules of Professional Conduct for lawyers in Ontario. The applicant filed a Notice of Application against the respondents. He attempted to establish that the respondents’ complaints were unfounded and he sought to prevent the LSO from investigating the complaints. He also sought an order for damages and other types of relief.

The Superior Court of Justice dismissed the application as being improperly before the court. The Court of Appeal dismissed the applicant’s appeal as being frivolous, vexatious and an abuse of the court’s process.
