(PUBLICATION BAN IN CASE)
Mr. Greenwood was charged with two counts of first degree murder in respect to the fatal shootings of two people. The evidence included testimony from an alleged co-assailant, evidence from an alleged participant in a conspiracy that resulted in the murders, and excerpts from Mr. Greenwood’s statement to police. The charge to the jury included instructions on party liability for aiding an offence and the co-conspirators’ exception to the rule against hearsay evidence. A jury convicted Mr. Greenwood of first degree murder on both counts. The Court of Appeal allowed an appeal, set aside the convictions and ordered a new trial.
