The applicant, an appellant in the Federal Court of Appeal, refused to acknowledge newly-assigned counsel representing the respondent Attorney General of Canada in the absence of an order permitting the Attorney General’s previous counsel to withdraw. The Attorney General filed an informal motion seeking, among other things, a direction that the applicant correspond with the counsel that the Attorney General may assign from time to time.

A single judge of the Federal Court of Appeal heard the motion and granted the requested direction, holding that the Attorney General is the solicitor of record and may designate, from time to time, such counsel to represent them as they see fit.
