As part of ongoing family law litigation, the applicant made several allegations against the respondent and her counsel. The respondent sought an order dismissing the motion on the grounds that the allegations were baseless, vindictive, and vexatious.

The motion judge issued an order in favour of the respondent, dismissing the motion and awarding costs on a full indemnity scale, in the sum of $24,353.24.

The motion for leave to appeal to the Divisional Court was dismissed. The Court of Appeal quashed the appeal.
