The applicant commenced an action against the respondents. The applicant alleges that the respondents impugned conduct amounts to a breach of statutory duties, neglect of duties, a breach of fiduciary duties, misfeasance in public office, conspiracy, negligence and a breach of the applicant’s rights under sections 7, 8, 12 and 15 of the Charter. The respondents successfully brought a motion to strike out the applicant’s statement of claim. The applicant’s appeal was dismissed.
