The applicant complained to the Workers Compensation Board of British Columbia (“WorkSafeBC”) about her employer. An officer declined to proceed with her complaint, and a review officer upheld that decision. The applicant sought judicial review. The chambers judge found the review officer’s decision to be unreasonable and remitted the matter for reconsideration. He declined to grant a declaration that WorkSafeBC had failed in its statutory mandate. The applicant appealed the refusal to grant the declaration. The Court of Appeal dismissed an appeal, finding no error in the chambers judge’s refusal to grant the declaration.
