In 2014, the applicants, Atkinsréalis Canada Inc. (formerly known as SNC-Lavalin Inc.) and Alain Blanchette, were found 70% liable, in solidum, with other parties, for damage caused to 857 residential buildings in the region of Trois-Rivières in connection with the use of pyrrhotite in aggregate forming part of the composition of concrete poured between 2003 and 2008 (see Deguise v. Montminy, 2014 QCCS 2672, affirmed on appeal, SNC-Lavalin inc. (Terratech inc. et SNC-Lavalin Environnement inc.) v. Deguise, 2020 QCCA 495, applications for leave to appeal to the Supreme Court dismissed, May 6, 2021, No. 39305). This proceeding is known as “the pyrrhotite case”. Following the release of the trial judgment, the applicants brought against the respondents, Lafarge Canada Inc. and Marie De Grosbois, a geologist, an anticipatory recursory action by way of call in warranty in which they asked that the respondents be held solidarily liable to the owners of the buildings. The Superior Court dismissed the applicants’ action, and the Court of Appeal dismissed the appeal.
