For the first seven years of the parties’ 23-year relationship, the applicant remained at home with the parties’ child and the respondent built his now-successful career in the film industry. Following this seven-year period, the applicant studied midwifery and worked as a midwife for the remaining 16 years of the relationship. She has since obtained an MBA and changed careers. On the date of separation, both parties were living beyond their means but nonetheless divided substantial family assets between them. The respondent’s income for support purposes is $200,000; the applicant’s is $100,000.

The trial judge held that the applicant’s domestic responsibilities in the first seven years of the relationship enabled the respondent to succeed in his career, and thus grounded the applicant’s entitlement to spousal support on a compensatory basis.

The Court of Appeal allowed the appeal, holding that the trial judge erred in principle by failing to consider the remaining 16 years of the relationship, during which compensation was achieved. Compensatory spousal support was therefore unnecessary.
