The applicant pleaded guilty to three counts of sexual assault and two counts of inviting a young person to touch a part of the body for a sexual purpose. After accounting for totality, the sentencing judge imposed a total sentence of ten years, a lifetime prohibition order under s. 161 of the Criminal Code and a lifetime order under the Sex Offender Information Registration Act, SC 2004, c. 10 [SOIRA]. The majority of the Court of Appeal allowed the sentence appeal in part: the two convictions under s. 153(1) of the Criminal Code are set aside; the duration of the SOIRA order is reduced to 20 years; and the s. 161 prohibition order pursuant to the Criminal Code is varied.
