Mr. Pellerin was fatally stabbed seven times in a parking lot. A witness saw him being beaten by two assailants and chased the assailants when they fled. The witness did not see a weapon. Mr. Hannan was charged with first degree murder and possession of a weapon for a purpose dangerous to the public peace. In the charge to the jury, the trial judge made multiple references to joint principal liability and common sense inferences. The jury acquitted Mr. Hannan of first degree murder, convicted him of second degree murder, and acquitted him on the count of possession of a weapon for a purpose dangerous to the public peace. The Court of Appeal dismissed an appeal.
