The applicants, Justice pour le Québec, Frédéric Bastien, Institut de recherche sur l’autodétermination des peuples et les indépendances nationales, Daniel Turp, Association de défense des droits individuels et collectifs du Québec and Etienne-Alexis Boucher, filed an application for a declaratory judgment with the Superior Court to have the Resolution regarding a proposed patriation and amendment of the Constitution of Canada, adopted by the Parliament of Canada in December 1981, the Canada Act 1982, including the Constitution Act, 1982, c. 11 (U.K.) and the Proclamation of the Constitution Act, 1982, made by letters patent signed in Ottawa on April 17, 1982, declared void, invalid and inapplicable under Canadian law. They seek, alternatively, a declaration that these same laws, this resolution and this proclamation are void, invalid and inapplicable in respect of Quebec only. In response to the application for a declaratory judgment, the respondent the Attorney General of Canada filed an application for dismissal and for a declaration of abuse. The Superior Court allowed the application for dismissal and for a declaration of abuse and dismissed the originating application for a declaratory judgment. The Court of Appeal dismissed the application for leave to appeal.
