The applicant, Phong Lam, sued the respondent, the Law Society of Ontario (“LSO”) in Federal Court. Mr. Lam alleged, among other things, that the LSO had “fabricated” previous judgments and decisions against him in other proceedings. Following a motion brought by the LSO pursuant to Rule 221 of the Federal Courts Rules, Associate Judge Cotter of the Federal Court struck Mr. Lam’s statement of claim, without leave to amend, and dismissed his action.
Mr. Lam filed a notice of appeal in the Federal Court of Appeal (“FCA”). By order dated May 24, 2024, the FCA ordered the removal of Mr. Lam’s notice of appeal from the court file, and closed the file, pursuant to Rule 74; it also held, pursuant to Rule 55, that its order was not subject to any reconsideration.
