In November 2023, a Superior Court judge, Lamarche J., declared that Rénovation Serge Lapierre inc. was, as garnishee, solidarily liable with Mr. Lapierre for the payment of damages and interest to the respondents. The appeal from that decision was dismissed.

In February 2024, the respondents seized Rénovation Serge Lapierre inc.’s bank account. In the present case, Mr. Lapierre filed an opposition to that seizure; the allegations focussed on the other decisions of Lamarche J. and of the Court of Appeal. The trial judge in the present case dismissed the motion opposing the seizure, noting that he could not sit in appeal from the judgments of the Court of Appeal and of Lamarche J.

The Court of Appeal dismissed Mr. Lapierre’s application for appeal because Rénovation Serge Lapierre inc. had to be represented by counsel and because the appeal did not raise a question that warranted the attention of the court and had no reasonable chance of success.
