The Quebec Superior Court dismissed the application as the proceeding was nonexistent on its face and the court was not regularly seized with an originating application that would allow it to proceed with this case. The explanation the applicant gave the court did not allow the court to entertain the matter. However, the court noted that the applicant’s rights are not prejudiced since he may, with the assistance of a lawyer or a legal clinic, institute proceedings that respect the civil procedure provisions in the future.
