One year after their son’s acquittal, both his parents sued the parents of the children who had given statements to the police authorities that they described as false. In doing so, the children had caused their son’s expulsion from secondary school and forced him to mount a defence in criminal proceedings. They claimed compensatory damages and moral and punitive damages for defamation and for injury to his honour and dignity. The Superior Court granted a motion to dismiss on the basis that the case was prescribed under art. 2929 C.C.Q. The majority of the Court of Appeal was instead of the view that the action was governed by three year prescription under art. 2925 C.C.Q. It set aside the trial judgment and dismissed the application to dismiss.
