On the evening of September 10, 2015, the patrol car of the applicant, Isabelle Morin, collided with a motorcycle, causing the rider’s death. The Court of Québec convicted Ms. Morin of dangerous driving causing death. The trial judge found that Ms. Morin’s conduct was a marked departure from the standard that would be observed by a reasonable police officer in the same circumstances. The Court of Appeal dismissed Ms. Morin’s appeal, finding, among other things, that the trial judge had made no reviewable error in taking into account, in his analysis, the duties and responsibilities generally resting upon police officers.
