Mr. Weber was convicted of common assault for having pulled a passing 15-year old youth off his bike, trying to take the youth’s phone from him, and uttering racial slurs. Sentencing was suspended and Mr. Weber was given 18-months of probation with conditions. A summary conviction appeal was dismissed. The Court of Appeal dismissed an application for leave to appeal.
