Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
Five psychiatrists and one family physician applied for a declaration of quarrelsomeness against D.F., alleging abusive, vexatious and quarrelsome conduct by him in the context of five private disciplinary complaints he filed with the disciplinary council of the Collège des médecins. The Superior Court declared D.F. to be a quarrelsome litigant. The Court of Appeal was of the view that the application for leave to appeal should be dismissed, the respondents’ motion to dismiss the appeal granted and the appeal dismissed because it had no chance of success and was therefore doomed to failure.
Lower court rulings
Application for declaration of quarrelsomeness allowed; D.F. declared to be quarrelsome litigan
Application for leave to appeal dismissed; motion to dismiss appeal granted; appeal dismissed
