Because the applicant is over 80 years of age, the Superintendent of Motor Vehicles (Superintendent) required medical information for the purpose of assessing his continuing fitness to drive. Included in the information were the results of cognitive testing. The Superintendent found the results of those tests opened the possibility of cognitive changes. The Superintendent therefore required the applicant to take a functional road assessment to determine fitness and ability to drive. The applicant failed his road test, and the Superintendent cancelled his driver’s licence. The applicant later retook the cognitive assessment, achieving higher results. The Superintendent reconsidered her licensing decision in light of the improved score, and offered the applicant a fresh road assessment as a path back to a driver’s licence. The applicant declined. The applicant commenced a judicial review proceeding seeking an order quashing the cancellation and reinstating his licence. The applicant’s judicial review application was dismissed. The Court of Appeal dismissed the appeal.
