Applicant Joanne Vaughan brought a motion before the Superior Court of Justice seeking an assessment of the legal fees she had paid to her former lawyer, respondent Andrew Burgess. The motion was dismissed, as was a subsequent motion to amend, set aside or vary the motion judge’s first order. The Court of Appeal for Ontario dismissed Ms. Vaughan’s appeal under Rule 2.1.01 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194. The Divisional Court dismissed Ms. Vaughan’s motion to extend the time to appeal.
