The applicant, Ms. Wood, filed an amended petition arising out of a complaint made by Ms. Wood subsequent to her termination of employment. The employer sought an order dismissing the petition pursuant to the provisions of Rule 20(26) of the Yukon Rule of Court, YOIC 2009/65. It maintained that the petition disclosed no reasonable claim, was vexatious and was an abuse of process of the court. It also sought an order of costs against Ms. Wood. The chambers judge struck the amended petition with costs. Ms. Wood’s application for leave to re-open her appeal was dismissed by the Court of Appeal.
