Following her trial in the Court of Québec, the applicant, Julie Lévesque, was convicted of contravening the provisions of an order in council made in the context of the COVID 19 pandemic by refusing to wear a face covering in a public place. The applicant appealed the trial judgment, but all of her grounds of appeal were dismissed by the Quebec Superior Court. The applicant then filed a motion for leave to appeal the Superior Court’s judgment to the Quebec Court of Appeal. Finding that the grounds of appeal relied on by the applicant were the same as those pleaded before the Superior Court and that there was no error warranting an appeal, the Court of Appeal dismissed her motion.
