The applicant commenced an action against the respondent and others seeking damages when the respondent terminated his commercial lease. The lease in question covered two hectares of Crown land located within the boundaries of a provincial park. The applicant asserted that the respondent had no legal right to terminate his lease because it had impermissibly permitted forest harvesting to take place within the park and, in doing so, acted in contravention of provincial legislation and the terms of the lease. A summary judgment application was brought by the respondent pursuant to Rule 7-2 of The King’s Bench Rules. The Chambers judge concluded there was no genuine issue requiring a trial, and dismissed the applicant’s action with fixed costs. The Court of Appeal dismissed the appeal.
