Civil procedure — Case Management — Whether Attorney General of Canada and Government of Canada, by delaying eligibility for medical assistance in dying, are showing lack of respect for patients with chronic psychiatric conditions and are in breach of s. 15(1) of Canadian Charter of Rights and Freedoms?

Summary

Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.

Mr. Mohammed filed a statement of claim alleging that exclusion from medical assistance in dying where the sole underlying medical condition is a mental illness breaches s. 15 of the Charter of Rights and Freedoms and seeking a constitutional exemption. The Attorney General of Canada brought a motion to strike the claim. The Ontario Superior Court of Justice scheduled the motion for a hearing and ordered a timetable for exchanging materials. The Ontario Divisional Court granted Mr. Mohammed an extension of time to seek leave to appeal and dismissed his application for leave to appeal.
