Mr. Jagadeesh worked in a CIBC call centre. He alleges CIBC discriminated against him and terminated his employment based on prohibited grounds. The Canadian Human Rights Commission dismissed the complaint.

In a first decision, the Federal Court granted Mr. Jagadeesh’s application for judicial review, directing that the matter be returned to the Commission for fresh investigation by a different investigator and for a new decision based on the full record. Following the new investigation, the Commission again dismissed Mr. Jagadeesh’s complaint.

The Federal Court dismissed the second judicial review, holding that the Commission reasonably concluded that the evidence did not warrant further investigation. The Federal Court of Appeal dismissed the appeal.
