The applicant is a physician whose surgical privileges have been suspended pending professional competence proceedings. He has commenced a variety of court actions against various parties in connection with these professional competence proceedings. The Court of Appeal for Saskatchewan declared the applicant a vexatious litigant in 2021. Following that declaration, the respondents commenced an originating application in the Court of King’s Bench to have the applicant declared a vexatious litigant in that court.
The application judge held that the cumulative history of the applicant’s litigation behaviour makes it clear that he has crossed the line into vexatious conduct. He was barred from commencing any litigation related to suspension of his surgical privileges without leave.
The applicant sought leave to appeal, and further sought the recusal of the judge hearing that application. The judge held that there was no basis for recusal in this case. He held that the proposed appeal was without merit and dismissed the application for leave to appeal.
