The parties married in 2013 and separated in 2017. The applicant commenced proceedings seeking a divorce, equalization of net family property and a declaration that the respondent held title to the matrimonial home in trust for both parties. The respondent sought a dismissal of the applicant’s claims, as well as a restraining order, an order for exclusive possession of the matrimonial home, an unequal division of any net family property and damages.
The trial judge dismissed the applicant’s claims. The respondent was granted exclusive possession of the matrimonial home and an unequal division of any net family property. The applicant was also ordered to return all of the respondent’s personal property to her within 30 days and to pay damages to the respondent in the amount of $75,000. The restraining order previously issued was ordered to remain in effect.
The Court of Appeal dismissed the applicant’s appeal.
