Mr. Côté enrolled in training to be completed online with an educational institution. He sought to obtain a certificate of participation for the hours of training completed, but the hours recorded were lower than the hours completed. Mr. Côté communicated several times with the persons responsible for that program, and on several occasions, he used abusive language.
Following a trial, he was convicted by a Court of Québec judge of the offence of harassing communications (s. 372(3) of the Criminal Code (hereinafter “Cr. C.”)). An appeal from the verdict was dismissed by the Superior Court. His attempts to obtain an extension of the time to file an application for leave to appeal before the Court of Appeal failed given that no grounds of appeal were submitted.
